If spouse A excluded his/her 3 houses (ie stipulated them in the antenuptial contract), the 3 houses will not be included when the accrual of the marriage is calculated at the end of the marriage. Spouse B will have a claim for half of the assets accrued (less the value of the 3 houses, if they were stipulated in the ANC). Kind regards, Michelle Light

You can contact the attorney who drew it up for you and ask them to obtain a copy for you. If they are not available, you can contact any attorney in Bloemfontein, give them your full names and ID numbers and ask them to obtain a copy for you from the Bloemfontein Deeds Office. How can I get a copy of our ANC if it was drawn up in 1992? We have moved to Durban and got married in Bloemfontein. We are buying a new property, and the attorneys is requesting a copy.

If a couple enters an ANC with accrual: Spouse A had 3 houses in his/her name and then 10 years later they sell one or two houses in order to buy a new one to live in – Does spouse B have claim to the new home that is paid for by spouse A’s profits from their previous homes?

If the accrual was excluded when the contract was signed, it will definitely be excluded if the parties get a divorce now.

Can the accrual system currently be excluded in an ANC contract – its this valid?
I.e. is it valid if an ANC contract drawn some time ago had excluded the acrual system, and the parties divorce now?
